What You’re Buying
NetIrrigate® provides a service that connects your irrigation equipment to the Internet such that they can be monitored and/or controlled through our mobile and web applications. Services may also include text, voice, email, and push notifications associated with critical irrigation system events. This service is sold via the CircleScout®, WireRat®, PumpProxy®, and NetIrrigate® Gold brands. We charge an annual subscription for this service at a price point depending on your level of desired functionality. If your subscription is active and your account is in good standing, the hardware required to connect your irrigation systems to our services is supplied directly by Net Irrigate at no additional charge. Net Irrigate retains ownership of the provided hardware during the subscription period and fully warrants its operation and functionality.
New Subscriptions and Renewals
The annual subscription period begins from the time of purchase and automatically renews after 365 days unless cancelled by the customer. Customers may cancel a new subscription within 30-days of purchase for a full refund minus shipping costs. Customers with multiple subscriptions may choose to group new subscriptions against a common renewal date. Any required hardware for a subscription is typically shipped within 2-3 business days of sign-up unless otherwise agreed to by the customer and Net Irrigate.
Hardware Replacement and Returns
Net Irrigate will immediately replace non-functioning hardware associated with an active subscription, at no charge, provided the original non-functioning hardware is returned to Net Irrigate within thirty (30) days. It is the customer’s responsibility to pay for outbound shipping of the new replacement unit; however, Net Irrigate will provide a pre-paid return shipping label to make sending the old non-functioning unit back easy. In the event we do no receive the old unit back as instructed, customers will be charged a $500 fee for non-return of the leased equipment.
Our remote monitoring equipment is the easiest to install among its peers. Since 2016, most growers have been self-installing our products due to the simplicity of their design and detailed on-line support documentation available at help.netirrigate.com. If you do not wish to self-install, Net Irrigate will dispatch a qualified professional for any field service needs at reasonable prices.
Dealers, Re-sellers, and Subscription Transfers
Subscriptions are sold direct by Net Irrigate online at store.netirrigate.com or by calling (800) 961-9549. Subscription prices are posted online. We make no distinction between distributors, dealers, re-sellers, and end users. Pricing discounts are strictly a function of purchase volume. Persons or entities that initially purchase subscriptions are financially responsible for them while active. Subscriptions may not be transferred to another financially responsible party within the first year. Upon renewal, a subscription may be transferred upon mutual consent of Net Irrigate, the original subscriber, and the new party. Upon transfer and renewal, subscription pricing shall be void of any volume discounts or promotions associated with the original subscriber. Request for transfer must be made at least seven (7) business days before the renewal date.
Termination and Cancellation
Customer must cancel the subscription on or before the renewal date to avoid being subject to pro-ration charges associated with cancellation. For example, if your subscription is set to renew on May 1st, and you cancel your subscription on June 15th (45 days into the renewal period), you will be charged 45/365ths of the annual subscription fee. First year subscriptions cannot be pro-rated if cancelled before the end of the initial one-year term. However, in the event the customer is unhappy with the performance of the service(s), a new subscription may be cancelled within 30-days of purchase for a full refund minus shipping costs.
Net Irrigate reserves the right to automatically terminate or suspend subscriptions in the event of product misuse, unauthorized transfers, and/or non-payment. In the event of termination, Net Irrigate will use any necessary and legal means to collect open balances. Customer acknowledges that Net Irrigate shall have the right to disrupt service integral to the hardware and software apps and shall have no liability for any damages arising from, or related to such disruptions of service associated with termination.
Upon subscription cancellation or termination, it is the customer’s responsibility to send back the leased hardware within thirty (30) days. Unreturned hardware will be subject to a $500 fee per unit charged against the subscribers account.
Customers acknowledge that Net Irrigate shall have no liability arising from the operation or use of the products for special, indirect, consequential, exemplary, punitive, or incidental damages (including loss of crop, equipment, data, revenue, or profits). The maximum liability of Net Irrigate to any person, firm, or corporation whatsoever arising out of or in the connection with any license, use, lease, or other employment of the hardware and/or services, shall in no case exceed the equivalent of the price paid by the customer for the subscriptions.
As part of the subscription, Net Irrigate uses a multiple of cellular and satellite services providers to connect your irrigation system to the Internet. Customer expressly acknowledges and agrees that it has no contractual relationship with the underlying wireless service provider or its affiliates and is not a third party beneficiary of any agreement between Net Irrigate and the underlying wireless carrier. In addition, customer acknowledges and agrees that the underlying carrier and its affiliates shall have no legal, equitable, or liability of any kind to customers and customer waives any and all claims or demands thereof. Net Irrigate also shall have no liability arising from or related to the instability or outage of the underlying carries’ wireless networks or that of its affiliates.
Customer acknowledges that certain subscriptions may include a theft monitoring alarm service and that it is the customer responsibility to physically test the theft alarm at least bi-annually or immediately following any service work performed on their irrigation system, to ensure the effectiveness of the service.
